Proclamation

 

            The following resolutions are proposed to be considered for adoption by the Town Board on Friday, October 24, 2014:

 

  1.       Set public hearings on waterways applications

 

            "Whereas", Bradley and Margaret Tolkin, 6 Charlie's Lane, has petitioned the Town of Shelter Island for permission to reconfigure and expand existing boat basin and associated dockage facilities as follows:  remove +/- 138' of existing timber bulkhead, wood walkway, ramp, and floating dock; install +/- 123' of vinyl bulkhead landward of existing bulkhead (to re removed); excavate approximately 750 cubic yards of soil (to be trucked off-site to an approved upland location) from approximately 1,312 square foot upland area between proposed bulkhead and existing bulkhead (to be removed) to a maximum depth of -4' MLLW; dredge approximately 100 cubic yards sand/silt spoil (to be retained on-site as backfill) from approximately +/- 1,093 square foot boat basin area seaward of existing bulkhead (to be removed) to a maximum depth of -4' MLLW; construct +/- 121 linear feet of 4' wide wood walkway landward of new bulkhead; and install a 10' by 13' jet ski float, 12' by 32" ramp, and (4) 5' by 20' floating docks secured by (5) 10" diameter pilings in boat basin; and construct +/- 38' of vinyl bulkhead in place of existing timber bulkhead and backfill with approximately 100 cubic yards spoil material from boat basin, now, Therefore

            BE IT RESOLVED,  That pursuant to Section 53-9 of the Code of the Town of Shelter Island, a public hearing will be held at 4:45 p. m., prevailing time, on the 14th day of November, 2014, in the Shelter Island Town Hall, Shelter Island, New York, for all interested persons to be heard in favor of or in opposition to the proposed construction.

 

            "Whereas", Michael G. McLean, 37 Tuthill Drive, has petitioned the Town of Shelter Island for permission to install a mooring in Shanty Bay of Coecles Harbor at a location designated as 41.07344° north and 72.28504° west, said mooring location was formerly occupied by the C-2731 McLean mooring, now, Therefore

            BE IT RESOLVED, That pursuant to Section 90-5 of the Code of the Town of Shelter Island, a public hearing will be held at 4:46 p. m., prevailing time, on the 14th day of November, 2014, in the Shelter Island Town Hall, Shelter Island, New York, for all interested persons to be heard in favor of or in opposition to the proposed installation.

 

 

  2.       Credit funds

           BE IT RESOLVED, That the Supervisor is hereby authorized and directed to credit the funds received from The New York State Department of Law Organized Crime Task Force in the amount of $4,086.00 to the A 3120. 4887-9 Police Department part time uniform account.

 

  3.       Supervisor's Office copier contract

 

            BE IT RESOLVED, That the Supervisor is hereby authorized and directed to expend the sum of $344.00 from the A 1220.491 Supervisor's contracts account to Carr Business Systems, 130 Spagnoli Road, Melville, New York 11747 for the annual maintenance of the copy machine in the Supervisor's office for the period October 14, 2014 through October 14, 2015.

 

  4.       Execute transportation agreement

 

            BE IT RESOLVED, That the Supervisor is hereby authorized and directed to execute the agreement between the Town of Shelter Island and the County of Suffolk for the provision of funding to the Town for essential transportation activities for seniors for the period April 1, 2014 through March 31, 2015, with an option, to be exercised at the County's discretion to September 30, 2015; said funding for said contract shall not exceed $8,016.00.

 

  5.       Execute Community Development Block Grant agreement

 

            BE IT RESOLVED, That the Supervisor is hereby authorized and directed to execute the Community Development Block Grant agreement between the County of Suffolk and the Town of Shelter Island for the period April 1, 2014 through March 31, 2016.

 

  6.       Execute Lyme Disease Task Force contract

 

            BE IT RESOLVED, That the Supervisor is hereby authorized and directed to execute the Lyme Disease Task Force contract in the amount of $100,00.00 for the period of April 1, 2014 to March 31, 2015.

 

  7.       Landfill scale maintenance contract

 

            BE IT RESOLVED, That the Supervisor is hereby authorized and directed to expend the sum of $1,140.00 from the 2014 A8160.484 Landfill office and miscellaneous account to Creative Information Systems, 27 Lowell Street, Suite 402, Manchester NH 03101 for the scale software support and maintenance for the period January 1, 2015 through December 31, 2015.

 

  8.       Return compliance fee to 5K Run/Walk

 

            "Whereas", the Shelter Island 5K Run/Walk paid a compliance fee of $100.00 for their 5K Run/Walk on October 18, 2014, and

            "Whereas", Jay Card, Jr., Superintendent of Highways, reported that no portion of the deposit was required, now, Therefore

            BE IT RESOLVED, That the Supervisor is hereby authorized and directed to return the $100.00 fee to the Shelter Island 5K Run/Walk, P. O. Box 599, Shelter Island, New York 11964.

 

  9.       Return compliance fee for Plant & Sing

 

            "Whereas", Sylvester Manor Educational Farm, Inc. paid a compliance fee of $100.00 for their "Plant & Sing" on October 11, 2014, and

            "Whereas", the Superintendent of Highways/Commissioner of Public Works reported that no portion of the deposit was required, now, Therefore

            BE IT RESOLVED, That the Supervisor is hereby authorized and directed to return the $100.00 fee to Sylvester Manor Educational Farm, Inc., P. O. Box 2029, Shelter Island, New York 11964.

 

  10.     Return fee for unused parking permits

 

            BE IT RESOLVED, That the Supervisor is hereby authorized and directed to return the fee of $105.00 to The Ram's Head Inn for three unused parking permits for the year 2014.

 

  11.     PCI Vulnerability scanning

 

            BE IT RESOLVED, That the Supervisor is hereby authorized and directed to expend the sum of $625.00 from the A 1620.476 Buildings Computer Maintenance account to East End Computer, LLC for five vulnerability scanning fees for the Town Hall, Police Department, Highways Department, Justice Court and Ambulance EMS for the period September 15, 2014 through September 14, 2015.

 

  12.     Act on Winters stake, mooring and pulley application

 

            "Whereas", Lynn Kay and Robert Winters, 4 Penny's Path, have petitioned the Town of Shelter Island for permission to install a stake, mooring and pulley system in West Neck Creek at the Bay Shore Drive Town Landing, at a location designated as latitude 41.05383° north and longitude 72.35715° west, and

            "Whereas", a public hearing was duly held on the 3rd day of October, 2014, for all interested persons to be heard in favor of or in opposition, now, Therefore

            BE IT RESOLVED, That the Town Clerk is hereby authorized to issue a permit for the aforementioned installation.

 

 13.     Act on Grosbard stake, mooring and pulley application

 

            "Whereas", Robert Grosbard, 74D North Cartwright Road, has petitioned the Town of Shelter Island for permission to install a stake, mooring and pulley system in Coecles Harbor at a location designated as latitude 41.0895° north and longitude 72.32091° west; said stake, mooring and pulley location was formerly occupied by the Raeder C-3181 stake, mooring and pulley system, and

            "Whereas", a public hearing was duly held on the 3rd day of October, 2014, for all interested persons to be heard in favor of or in opposition, now, Therefore

            BE IT RESOLVED, That the Town Clerk is hereby authorized to issue a permit for the aforementioned installation.

 

  14.     Act on Valeri mooring application

 

            "Whereas", Jean-Pierre and Pamela Valeri, 47D South Ferry Road, have petitioned the Town of Shelter Island for permission to install a mooring in Coecles Harbor at a location approximately 250 feet north of applicants' dock and approximately 150 feet northwest of the Perry C-1277 mooring; said mooring location is designated as latitude 41.06742° north and 72.30526° west and was formerly occupied by the C-3049 Roush mooring, and

            "Whereas", a public hearing was duly held on the 3rd day of October, 2014, for all interested persons to be heard in favor of or in opposition, now, Therefore

            BE IT RESOLVED, That the Town Clerk is hereby authorized to issue a permit for the aforementioned installation.

 

  15.     Act on American Direct, LLC rock revetment application

 

            "Whereas", American Direct, LLC, 1 Shorewood Court, has petitioned the Town of Shelter Island for permission to construct 650 feet of 2.5 to 5 ton rock revetment, recontour top edge of bluff, regrade slope adding additional sand fill as required, install jute matting and revegetate with Cape American beachgrass, construct new 3 foot wide access stairway from top of bluff down to  beach and provide 80 foot wide swim area on beach removing existing concrete debris from area, in west section, and construct 370 feet of 1.5 to 3 ton rock revetment, recontour top edge of bluff, regrade slope adding additional sand fill as required, install jute matting and revegetate with Cape American beachgrass, in east section, and

            "Whereas", a public hearing was duly held on the 3rd day of October, 2014, for all interested persons to be heard in favor of or in opposition, now, Therefore

            BE IT RESOLVED, That pursuant to Part 617, Section 617.10 of the State Environmental Quality Review Act and Chapter 60 of the Code of the Town of Shelter Island, notice is hereby given that the Town Board, as lead agency, has determined that the project will not have a significant effect on the environment, and a Draft Environmental Impact Statement will not be prepared.

            Environmental Review Status pursuant to Chapter 60 of the Town Code of the Town of Shelter Island:  Type II.

            Reasons supporting this determination: 

                        The proposed rock revetment:

            1.         will not cause an obstruction into navigable channels or an interference with navigation;

            2.         will not adversely affect the public's right to use Town waters or land under Town waters;

            3.         will not adversely affect shellfishing grounds or other aquatic wildlife which may exist in the immediate area;

            4.         will not adversely affect the quality of the tidal waters, shoreline or beaches;

            5.         will not adversely affect the rights of adjacent residents; and

            BE IT FURTHER RESOLVED, That the Town Clerk is hereby authorized to issue a permit for the aforementioned construction as per specifications filed, after said applicant, pursuant to Section 53-9 of the Code of the Town of Shelter Island, has filed with the Town Clerk a certificate that the owner has at least three hundred thousand ($300,000.00) dollars liability insurance on the location and operations covered by said permit, a copy of the contractor's current Home Improvement Contractor's License and a certificate from the contractor performing the operations covered by said permit that said contractor has an owner's/contractor's policy issued in favor of the Town of Shelter Island for the liability limits of at least five hundred thousand ($500,000.00) dollars covering operations of the contractor pursuant to said permit, and

            BE IT FURTHER RESOLVED, That said operations shall be completed within one (1) year from the date of issuance of this permit; said permit is subject to the recommended limitations and any requirements that may be necessary under the New York State Department of Environmental Conservation, the Army Corps of Engineers, and any other agencies having jurisdiction.

 

  16.     Set public hearing on Community Development funds for 2015

 

            "Whereas", the Town of Shelter lsland is a member of the Suffolk County Community Development Consortium, and

            "Whereas", the Town of Shelter Island expects to receive approximately $13,570.00 in Federal Community Development Block Grant Funds in 2015, now, Therefore

            BE IT RESOLVED, That a public hearing will be held at 4:50 p. m., prevailing time, on the 14th day of November 2014, in the Shelter Island Town Hall, Shelter Island, New York for all interested residents to express citizens' views on the local community development needs to be met with these funds.

 

  17.     Set public hearing on Local Law re:  amend wetlands fines

 

            BE IT RESOLVED, That the Town Board hereby calls for a public hearing to be held at 4:55 p. m., prevailing time, on the 14th day of November, 2014, in the Shelter Island Town Hall, Shelter Island, New York, for all interested persons to be heard in favor of or in opposition to a proposed Local Law entitled A LOCAL LAW TO AMEND CHAPTER 129 WETLANDS RE:  PENALTIES FOR OFFENSES, to wit:

            Section 1. Amend the second sentence of Section 129-12 D. to read as follows:  For a second and each subsequent offense, the violator shall be guilty of a misdemeanor punishable by a fine of not exceeding five thousand ($5,000.00) dollars or a term of imprisonment not to exceed fifteen (15) days, or both.

            Section 2.  This Local Law shall become effective immediately upon filing with the Secretary of State.
